- 2001 onwards: Chairperson of the Department
Teaching responsibility:
Negotiable instruments, Banking, International Business Transactions and Insurance. I teach both in the Law and the Commerce Faculty, and, on LLM level, have been and am currently involved in the LLM programmes of several universities: Stellenbosch, Natal, Potchefstroom, Cape Town (for several years until 2001), Namibia (2001 and 2002). I have also been the convenor of my own faculty’s distance education LLM programme (by inter-active satellite TV) since its inception in 1999. This LLM is focused on international trade law.
During the period 2001-2003 I taught, as visiting professor, a total of 7 credits in the business school of the International University of Germany in Bruchsal (Germany). This was all in the broad area of international business transactions.
I have supervised some 25 or so mini theses on LLM level (roughly equal to a typical article in a law journal), 1 full masters thesis (a comparative analysis of banking supervision in Germany and South Africa) and am currently acting as supervisor or co-supervisor of two doctoral students.
I have acted as moderator and external examiner for the following courses: the University of Cape Town’s courses in Banking Law (LLB level) and International Trade Law (LLM level); the University of the Western Cape’s LLM course on International Trade Law; the University of Durban-Westville’s LLM on International Trade and Banking; the University of Port Elizabeth’s course on Payment Instruments (LLB level), and the University of Namibia’s course on negotiable instruments (LLB level).
I taught a one-credit elective (on instruments of payment and guarantee in international business transactions) at the University of Gainesville, Florida, during January and February 2003 under an exchange agreement between our respective Universities.
My courses, including those taught abroad, have regularly been evaluated and the results are available on request.
During the period September 2003 – April 2004 I coached a team from Stellenbosch which participated in the 11th Willem Vis international commercial arbitration moot in Vienna. The team was eventually ranked 45th out of the 135 participating law schools. I also acted as arbitrator in both the general and elimination rounds of the competition.
NRF Rating
Researchers in the natural sciences in South Africa have for many years been part of a system whereby they could subject their work to the National Research Foundation (NRF) to be rated. Independent referees, of whom half must be from abroad, report back to the NRF, and on the basis of these reports, the researchers are rated. This system was extended to the humanities recently. For better or for worse (the system is not without its controversy), and under considerable pressure from the University authorities, I submitted myself to the system and received a C2 rating. This translates, in the terminology of the NRF, to the following: “All the reviewers are firmly convinced that the researcher concerned has a sustained recent record of productivity in the field and is recognised by his peers as having: - produced a body of quality work, the core of which has coherence and attests to ongoing engagement with the field; - demonstrated the ability to conceptualise problems and apply research methods to investigating them.”
